All products are manufactured, printed, or customized strictly in accordance with the specifications, artwork, branding elements, and written instructions provided by the Client. Earth Tribe Inc does not independently verify or investigate the legal status, ownership, licensing validity, or regulatory compliance of any materials supplied by the Client.
All website content, including but not limited to layouts, graphics, digital assets, product representations, catalog structures, written materials, and visual compositions, constitutes proprietary intellectual property of Earth Tribe Inc and is protected under applicable copyright, trademark, and related intellectual property laws. Unauthorized copying, reproduction, scraping, extraction, republication, modification, or commercial exploitation is strictly prohibited and may result in civil and criminal action.

The Client agrees to fully indemnify, defend, and hold harmless Earth Tribe Inc, its proprietor, partners, directors, officers, employees, agents, affiliates, contractors, and vendors from and against any and all claims, notices, demands, actions, proceedings, liabilities, penalties, damages, losses, settlements, reputational harm, and legal expenses (including attorney fees) arising directly or indirectly from (i) intellectual property infringement, (ii) unauthorized use of trademarks or copyrighted material, (iii) regulatory violations related to branding or labeling, (iv) misleading representations made by the Client, or (v) any distribution or commercial deployment of customized products. This indemnity obligation shall survive termination or completion of any engagement.
To the maximum extent permitted by law, Earth Tribe Inc shall not be liable for any indirect, incidental, punitive, special, exemplary, or consequential damages, including but not limited to loss of profits, business interruption, reputational damage, contractual penalties, or third-party claims. Under no circumstances shall Earth Tribe Inc’s aggregate liability exceed the total monetary value of the specific order giving rise to the claim. Pricing reflects this allocation of commercial risk.
Earth Tribe Inc reserves the absolute right to refuse, suspend, or terminate any engagement where there is suspected intellectual property infringement, regulatory exposure, reputational risk, or misrepresentation by the Client. Such action shall not constitute breach of contract.
These Terms shall be governed by and construed in accordance with the laws of India, and any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of courts located in New Delhi, India.
Earth Tribe collects and processes personal and corporate information including names, designations, company details, contact information, uploaded artwork, inquiry data, communication records, and technical usage information for legitimate business purposes. Such information may be used for responding to inquiries, preparing quotations, executing transactions, maintaining business records, operational analytics, strategic planning, and direct marketing initiatives.
By submitting contact details through the website, email, or other communication channels, the Client expressly consents to receiving commercial communications, catalogs, promotional materials, and marketing outreach related to Earth Tribe’s services. Consent may be withdrawn through written notification; however, withdrawal shall not affect prior lawful processing.
Earth Tribe may retain submitted artwork, order history, and transactional records for compliance, archival, repeat-order facilitation, internal analytics, and business continuity. Non-confidential business information may be used for internal marketing intelligence and commercial development purposes.
